ADF to US Supreme Court: Keep safeguards in place for chemical abortion drugs

The following quote may be attributed to Alliance Defending Freedom Senior Counsel Erin Hawley, vice president of the Center for Life and regulatory practice, regarding a conditional cross-petition ADF attorneys filed with the U.S. Supreme Court Thursday in Alliance for Hippocratic Medicine v. U.S. Food and Drug Administration. The cross-petition asks the high court to deny the Biden administration’s and Danco Laboratories’ request for the court to hear the case and instead to let stand the U.S. Court of Appeals for the 5th Circuit’s ruling that restored critical safeguards for chemical abortion drugs. The cross-petition also highlights how the FDA’s unlawful, politicalized actions on chemical abortion drugs began when the agency first approved the drugs in 2000:

“The 5th Circuit correctly held the FDA accountable for failing to do its job and rightfully restored crucial safeguards for women and girls, including ending illegal mail-order abortions. The FDA’s recent actions on chemical abortion drugs have harmed the health of countless women and girls and undermined the rule of law by illegally removing every meaningful safeguard from the chemical abortion drug regimen. The FDA’s unprecedented actions did not reflect scientific judgment but rather revealed politically driven decisions to push a dangerous drug regimen without regard to women’s health. We are urging the Supreme Court to deny the Biden administration’s request to overrule the decision of the 5th Circuit.”

After the 5th Circuit ruled in August that the FDA must restore critical safeguards for chemical abortion drugs and disallow their shipment by mail, the U.S. Department of Justice and Danco, a chemical abortion drug manufacturer, filed petitions with the Supreme Court asking it to hear the case. The ADF cross-petition argues that the court should deny those petitions and leave protections for women in place, but if the court grants those petitions, it should consider all of FDA’s unlawful actions at once and grant the conditional cross-petition as well.
